Immigration agents illegally detain Obama program 'dreamer,' lawsuit says


Some saw the detention as the opening salvo in an attack on former President Barack Obama's Deferred Action for Childhood Arrivals program, while federal authorities suggested it was simply a routine exercise of their authority.

The 2012 Obama administration program provides temporary protection from deportation and work permits to 750,000 young immigrants brought to the their families as children. His work permit should have been valid for at least another year, according to his attorneys. They were looking for his father, who has an order to be deported from the country. ICE spokeswoman Rose Richeson said Ramirez was a "self-admitted gang member" who was arrested during "an operation targeting a prior-deported felon", but declined to elaborate on the matter.

Medina's lawyers say his lawsuit, seeking his immediate release, is the first of its kind challenging the detention of a Dreamer.

They hope that Ramirez's arrest is an isolated incident and does not indicate that the Department of Homeland Security is proceeding in a new direction when it comes to individuals brought to the United States as undocumented children. "This young man was carefully vetted by the Obama administration, cleared background checks and it was determined he was not a priority for removal, and, in fact, it is a benefit for him and people like him to be able to live and work here". She said the arrests took place across the street and not on church property.

The case has raised questions: Was Ramirez's detention, as the government says, a routine arrest of someone who posed a threat to the US because of his alleged gang ties? "Did you see that?'
