Miller said on Fox News Sunday that the White House is considering a new executive order as well as requesting an emergency stay from the U.S. Supreme Court, an appeal of the 9th Circuit's decision or more action at the Seattle district court, UPI reported. "We'll see. Monday or Tuesday". He might rewrite the original order to explicitly exclude green card holders, or permanent residents, said a congressional aide familiar with the matter, who asked not to be identified. By doing so it would alleviate some of the major concerns about the ban, reports The Hill.

"It very well could be", he said aboard Air Force One when asked if his intent is to issue a new order.

White House press secretary Sean Spicer told NBC News that "every option is on the table", including taking the current case to the Supreme Court.

In upholding the suspension, the United States court of appeals in San Francisco said Thursday the government had provided no evidence that any alien from the countries named in the order had carried out a terrorist attack on U.S. soil.

Stephen Miller told USA media the court ruling was a "judicial usurpation of power" and that "the president's powers here are beyond question".

Loyola Law School professor Jessica Levinson, a critic of the executive order, argued that the court needed to send the message the president should not be "un-reviewable" - especially for an order considered by many to be a "Muslim ban". We'll win that battle. "It's a decision that we'll win very easily", Trump ended.

"The administration is looking through all the options on how to move forward". The vote is likely to occur after the briefs are filed.

"This is probably going to the Supreme Court, but I don't think it's going anywhere good for Donald Trump - even if the Supreme Court rules along party lines and is deadlocked, because the lower court's decision would stand".

The White House has not provided any evidence to support Trump's view that a ban on travellers from the seven countries was urgently needed.
