Cowboys will have Ezekiel Elliott for at least next two games


The U.S. Court of Appeals for the Fifth Circuit has spoken, sort of.

Here's a bit more legalese regarding the issue.

The motion seeks an emergency stay on the preliminary injunction filed on Elliott's behalf by the NFLPA. Dallas travels to the desert to play the Arizona Cardinals on Monday Night Football, with Elliott at its disposal. Both teams feature defenses that could potentially give Dak Prescott trouble, so having Elliott certainly will be a boon. With the hearing scheduled for the first week of October, Elliott will remain eligible to play this week and next week against the Los Angeles Rams.

Mazzant's decision to temporarily block the suspension was based on the appearance of "fundamental unfairness" in the NFL's handling of Elliott's case, particularly his appeal that was heard by Harold Henderson.

Elliott's suspension could commence as soon as Week Five, depending on whether the Fifth Circuit stays the injunction or rules that the injunction was erroneously granted in quickly after the October 2 hearing.

The court of appeals has issued a deadline of 5 p.m. Wednesday, September 27, to present arguments as to why, or why not, the case should have originally started in District Court for East Texas.

Elliott will be able to play in the next two Cowboys games before the hearing is held.

If the NFL is granted a stay of the injunction, the league reserves the right to suspend Elliott immediately.
