Dentists Rajesh and Nupur Talwar cleared of daughter Aarushi's murder


In a major relief for Nupur and Rajesh Talwar, the Allahabad High Court on Thursday overruled the trial court judgment in the Aarushi Talwar murder case and declared them both innocent.

In November 2013, a special CBI court in Ghaziabad had convicted the Talwars for murdering daughter Aarushi and Hemraj and sentenced them to life.

On May 16, 2008, 13-year-old Aarushi was found dead in her room with her throat slit. There were wounds all over his body and the door to the terrace was found locked from inside. Onus on Talwars to prove that who else could have killed Aarushi and Hemraj.

The CBI said it would study the High Court order and decide the future course of action. Therefore, Rajesh Talwar and Nupur Talwar, can not be penalised for the murder case of their daughter Aarushi and domestic help Hemraj. A series of lapses marked the investigation, both when it was handled originally by the Noida police and then by the CBI.

Pinaki Misra, another defence counsel, said the CBI court judgment was "absolutely perverse and the High Court has set it aside correctly". A group of three domestic helpers who worked in the same neighbourhood were arrested as suspects, then released after the CBI ran narco-analysis or brain-mapping tests on them which are inadmissible in court as evidence before admitting it had no evidence against them.

CBI submitted a closure report on the case in December, 2010 on the basis of "insufficient evidence".

The CBI had suspected Aarushi's father Rajesh Talwar to commit the double murders based on circumstantial evidence, though the CBI did not convict him due to lack of proper evidence. The court hall was a packed one as the judge pronounced the verdict.

In the year, 2013 Aarushi's parents Nupur Talwar and Rajesh Talwar, were convicted and were sentenced to life by a special CBI Court.

The three were later freed after no evidence was found against them.
