Almost a year after Apollo 13 star Bill Paxton died from complications from surgery, his family has filed a wrongful-death lawsuit against the surgeon and hospital that treated him.

His widow Louise Paxton, son James, daughter Lydia and his estate filed suit late last week in Los Angeles Superior Court, alleging wrongful death, negligence and battery on the part of cardiovascular surgeon Ali Khoynezhad and Cedars-Sinai Medical Center.

"Bill Paxton and his family trusted the physicians and staff at this medical facility but instead Cedars-Sinai betrayed their trust", the family's attorney, Bruce Broillet, said in the release, according to the Fort-Worth Telegram. "We are pursuing accountability and justice from a physician and a hospital that failed to adequately protect Mr. Paxton", plaintiff attorney Steve Heimberg says in the release.

The surgery, Paxton's family claims, contributed to the post-surgical complications that led to stroke and the actor's death.

Dr. Khoynezhad left his position as a surgeon at Cedars-Sinai shortly after Paxton's death, according to the release.

Paxton died on February 25, 2017 - 11 days after the procedure - and his family is seeking unspecified damages. The document alleges that Paxton consulted Khoynezhad, Cedars-Sinai and other defendants in connection with cardiac conditions that included bicuspid aortic valve and aortic aneurysm.

They claim the hospital and the doctor misrepresented the risks of the surgery and failed to disclose that it was an unconventional approach that was "beyond the scope" of the doctor's experience and privileges, according to the Hollywood Reporter.

The lawsuit said that after undergoing the procedure, Paxton suffered multiple complications including excessive bleeding and cardiogenic shock, where the heart muscle is so damaged it can no longer pump enough blood for the body.
