Justice Luka Kimaru quashed the action taken by Interior Cabinet secretary Fred Matiang'i and Director of the Immigration to revoke Miguna's citizenship and cancel his Kenyan passport.

In a statement sent to newsrooms, Principal Secretary Ministry of Interior Karanja Kibicho faulted the ruling saying that the deportation was conducted within the confines of the law.

Soon after the judgement, Miguna, in a telephone interview, said the Government had no authority to withdraw his citizenship. Justice Kimaru said Miguna was deported while in the custody of the court and found Inspector General of Police Joseph Boinnet and Director of Criminal Investigation George Kinoti in contempt of court for failing to produce him in court as he had ordered.

He cited eight recent instances, which he called "evidence of bias, double standards, impunity and poor leadership on the part of the judiciary", including Odinga's boycott of the repeat vote, which Maraga did not condemn.

Kenyans on Twitter responded with cheer to the High Court judgment.

The office of the chief justice said declined to comment on the letter.
