No decision on Justice KM Joseph as yet


They are: Indira Banerjee of the Madras High court who is originally from the Calcutta HC; Subhash Reddy of Gujarat HC who is originally from Telangana and Andhra Pradesh HC; and Karnataka HC chief justice Dinesh Maheshwari who is originally from Rajasthan HC.

The decision about Chattisgarh Chief Justice K M Joseph has already been taken in the last meeting- that his name will be re-recommended - but no decision was possible on the other judges and the Collegium said that this would take time.

The matter was referred to the Committee on Ethics and Privileges to investigate which recommended 181 days of suspension.

It had then also made a decision to consider the names of other High Court Judges for elevation as judges of the Supreme Court. The Centre had sent back Justice Joseph's name for reconsideration. The Centre had said Justice Joseph's "comparatively small" parent High Court of Kerala was already "adequately represented" in the apex court and among High Court Chief Justices. However, Justice Gogoi, who will succeed Justice Misra on October 3 as CJI, and Justice Lokur had agreed with CJI Misra that when there were seven vacancies in the SC, it would be incongruous for the collegium to send only one name to the government. This issue may come up at the next meeting. Both the proposals were sent on January 10 this year.

The Supreme Court collegium has again deferred a formal decision on sending the file relating to the elevation of Justice K.M. Joseph as a judge of the apex court, though it has stuck to its decision of "in principle, unanimously" reiterating the recommendation for his promotion.
